Browsing the Afteriize site (hereinafter the “Site”) published by MGTS implies unreserved acceptance and compliance by any Internet user browsing the Site (hereinafter the “User”) with these terms of use.

It should be noted that the Site is intended for any individual of legal age and any minor holding parental consent, which MGTS may request at its discretion.

1.Behavior on the Site

While using the Site, the User shall refrain from committing any illegal act, and in particular from :

Extracting, collecting, recording, publishing or exploiting in any way whatsoever the personal data of third parties or information relating to their private life or right to image;

Usurping the identity of a third party;

Extracting, recording or exploiting, for purposes other than the sole display during browsing on this Site, the content of third parties subject to intellectual property rights;

Store, disseminate or publish any content that is prejudicial, insulting, racist, inciting hatred, revisionist or contrary to good morals;

Store, disseminate or publish any information that reveals, directly or indirectly, the User’s political, philosophical or religious opinions, trade union membership, state of health or sexual orientation;

Store, disseminate or publish any content that may prejudice, directly or indirectly, the interests of MGTS.
The User also agrees not to commit any act contrary to the values and interests of MGTS.

Should this not be the case, the Site reserves the right not to confirm, suspend or delete the account of the User who has committed these acts, and not to publish or delete his or her litigious publications.

2.Intellectual property

The whole of the Site constitutes a work protected by the laws in force on intellectual property, including legislation relating to copyright and the rights of the producer of databases. As such:

All graphic elements, images, photographs, videos, texts, animated sequences with or without sound, presented on the Site, as well as the title, design, form of the Site, its content such as comments and customer reviews, editorials and their organization, as well as any compilation of software, fundamental source code, software (including applets) constituting and/or represented on the Site are, as the case may be, the property of MGTS or of third parties having authorized MGTS to represent them on the Site.

The name, brands, logos and slogans, graphic charters, product and Site names, domain names, downloadable documents, photographic representations and all related distinctive signs are, unless otherwise specified, the property of MGTS or third parties having authorized MGTS to represent them on the Site.

Any reproduction, disclosure, distribution, dissemination, use, representation, modification, transcription, adaptation, translation, and/or transformation, whether partial or total, whatever the medium and whatever the process used, are strictly forbidden, unless prior and express authorization has been obtained from the publication manager.

No judicial or administrative final, the other stipulations will retain their force and scope. MGTS will use its best efforts to replace any other stipulation as soon as possible with a valid one as close as possible to the spirit of the present contract. The fact that one of the parties has not demanded the application of any clause of the present conditions, whether permanently or temporarily, may in no case be considered as a renunciation of the said clause.

Any transfer of any element of the Site to another Site or to any other medium (paper, digital medium, film, etc.) is forbidden, except with the express prior authorization of the person responsible for the publication.

MGTS grants Users a non-exclusive, revocable license to use the Site and its contents, with no right to sub-license and valid only for simple access, browsing and use related to the Site. This license does not grant Users any other right, in particular any right of commercial exploitation of the Site and its content.

Any infringement of the provisions of this article constitutes an offence of counterfeiting and renders the perpetrator civilly and criminally liable.

3. Responsibility
Consultation and use of the Site is at the User’s own risk.

The use of the Site by the User implies knowledge and acceptance of the characteristics and limits of the technologies inherent in the Internet, particularly with regard to response times for consulting or querying the server hosting the Site, technical performance, risks of interruption and, more generally, any risk incurred during data transmission.

Consequently, MGTS cannot under any circumstances be held responsible, in particular, for any network malfunction preventing the proper functioning of the Site, for the loss of any data, for the consequences of any computer virus, bug, anomaly or failure, or even for any damage caused to the User’s computer.

The User is informed that MGTS may temporarily interrupt access to the Site for technical reasons, notably to ensure maintenance. The User accepts these interruptions and renounces any claim in this regard.

Finally, the Site may host links to third-party sites. The User acknowledges that MGTS has no control over the content of these third-party Sites and that access to these third-party Sites is the sole responsibility of the User.

MGTS reminds the User that this Site is provided free of charge, and therefore cannot be held responsible in the event of malfunction or erroneous information reproduced on the Site. MGTS undertakes to do its utmost to keep such errors to a minimum.

By using the Site, the User is responsible for any damage caused, under the conditions of common law, in disregard of the present GCU.

4. Entirety
If one or more stipulations of the present terms and conditions are declared null and void by application of a law, regulation or following a final judicial or administrative decision, the other stipulations will retain their force and scope. MGTS will use its best efforts to replace the invalid stipulation as soon as possible with a valid stipulation as close as possible to the spirit of the present contract. The fact that one of the parties has not required the application of any clause of the present conditions, permanently or temporarily, can in no way be considered as a renunciation of the said clause.

5. Applicable law / Disputes
The present conditions are governed by French law.
